What You Need to Know About AER Directive 038
Who Needs to Comply?
Directive 038 applies to all operators of existing and proposed facilities under the jurisdiction of the AER, including upstream, midstream and downstream energy-related facilities.
Anyone who owns, operates, or designs an Oil and Gas facility that produces noise is required to ensure compliance with Directive 038.
When Does Directive 038 Apply?
An NIA is required by all facilities under Directive 038 prior to submitting a facility application or if an existing facility receives a noise complaint.
The NIA must consider cumulative noise impacts from all nearby facilities on area residences. An NIA is still required even if there are no human dwellings within 1.5 km of the facility.
